  1.                    ATTENTION - READ CAREFULLY BEFORE USING

  3.        By using the software accompanying this agreement, you indicate
  4.        your acceptance of the following Pearl Software License Agreement.

  7.        PEARL SOFTWARE DEMO LICENSE AGREEMENT
  8.  
  9.        This is a legal agreement between you, the end user, and Pearl
  10.        Software.  By using the software accompanying this agreement,
  11.        you indicate your acceptance of the following Pearl Software
  12.        DEMO License Agreement.  If you do not agree to the terms of
  13.        this agreement, then don't use the software.  Throughout this
  14.        agreement the word "program" shall mean only the DEMO version
  15.        of GNU EMACS for Windows, provided by Pearl Software either at
  16.        no charge or for a nominal fee (to recover media and copying
  17.        costs).  The License agreement for Pearl Software's supported
  18.        version of GNU EMACS for Windows is different from this agree-
  19.        ment.  In particular the terms of this agreement do not apply
  20.        to the supported version of GNU EMACS for Windows (c.f. Pearl
  21.        Software License Agreement (GL01-1032-0293)).  This agreement
  22.        only covers the actual parts of GNU EMACS for Windows that are
  23.        subject to Pearl Software Copyright marks.  In particular, this
  24.        agreement does not cover any of the software subject to the
  25.        Free Software Foundation Copyright marks.  Pearl Software has
  26.        no ownership claims in the Free Software Foundation's GNU
  27.        Emacs.

  29.        LICENSE
  30.  
  31.        Pearl Software hereby grants you a non-exclusive, non-
  32.        transferable license to use the copy of the program and accom-
  33.        panying documentation as set forth below:

  35.        You may:
  36.  
  37.        a.  Use program on any compatible computer,
  38.  
  39.        b.  make copies of the program, and documentation, in machine
  40.        readable form, provided that you reproduce all copyright and
  41.        other proprietary notices on the copy;
  42.  
  43.        c. give your copy to others, provided you also provide both
  44.        copies of the program and the documentation and provided the
  45.        recipient agrees to accept the terms and conditions of this
  46.        agreement.

  48.        Pearl Software retains ownership of the enclosed program and
  49.        accompanying documentation, and each copy thereof, and is pro-
  50.        tected by United States copyright law and international treaty
  51.        provisions.  This license is not a sale.  Pearl Software has no
  52.        ownership or claim to the Free Software Foundation's GNU EMACS.

  54.        RESTRICTIONS
  55.  
  56.        You may not:
  57.  
  58.        a.  sell all or any part of the the program or documentation,
  59.  
  60.        b.  alter, modify, translate, reverse engineer, decompile,
  61.        disassemble the program or the accompanying documentation;
  62.  
  63.        c.  loan, rent, sub-license, or otherwise transfer the program
  64.        or the documentation except as provided above.
  65.  
  66.        Unauthorized copying, except as allowed above, of the program
  67.        or the accompanying documentation, or failure to comply with
  68.        the above restrictions, will result in the automatic termina-
  69.        tion of this license and will make available to Pearl Software
  70.        other legal remedies.

  72.        LIMITED WARRANTY AND DISCLAIMER

  74.        PEARL SOFTWARE MAKES AND YOU RECEIVE NO WARRANTY, EXPRESS,
  75.        IMPLIED, STATUTORY OR OTHERWISE, AND PEARL SOFTWARE SPECIFI-
  76.        CALLY DISCLAIMS ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FIT-
  77.        NESS FOR A PARTICULAR PURPOSE.  PEARL SOFTWARE does not warrant
  78.        that the functions contained in the program will meet your
  79.        requirements or that the operation of the program will be unin-
  80.        terrupted or error free.

  82.        SOME STATES DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES SO
  83.        THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.   THIS WARRANTY
  84.        GIVES YOU SPECIFIC LEGAL RIGHTS.   YOU MAY ALSO HAVE OTHER
  85.        RIGHTS WHICH VARY FROM STATE TO STATE.

  87.        LIMITATION OF LIABILITY

  89.        PEARL SOFTWARE'S LIABILITY, ARISING OUT OF THIS AGREEMENT WILL
  90.        BE LIMITED TO THE PRICE PAID (IF ANY) FOR THE PROGRAM.  IN NO
  91.        EVENT WILL PEARL SOFTWARE BE LIABLE FOR LOSS OF DATA, LOST PRO-
  92.        FITS, COST OF COVER OR ANY SPECIAL, INCIDENTAL, CONSEQUENTIAL
  93.        OR INDIRECT DAMAGES ARISING FROM THE USE OF THE PROGRAM OR
  94.        ACCOMPANYING DOCUMENTATION,  HOWEVER CAUSED AND ON ANY THEORY
  95.        OF LIABILITY.  THIS LIMITATION WILL APPLY EVEN IF PEARL
  96.        SOFTWARE OR AN AUTHORIZED DEALER HAS BEEN ADVISED OF THE POSSI-
  97.        BILITY OF SUCH DAMAGE, AND NOTWITHSTANDING ANY FAILURE OF
  98.        ESSENTIAL PURPOSE OF ANY LIMITED REMEDY.  YOU ACKNOWLEDGE THAT
  99.        THE LICENSE FEE (WHICH IS FREE OR NOMINAL TO RECOVER MEDIA AND
  100.        COPYING COSTS) REFLECTS THIS ALLOCATION OF RISK.  SOME STATES
  101.        DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR
  102.        INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION
  103.        MAY NOT APPLY TO YOU.

  105.        GOVERNMENT USE
  106.  
  107.        Use, duplication or disclosure by the United States Government
  108.        is subject to restrictions as set forth in subdivisions
  109.        (c)(1)(ii) of the Rights in Technical Data and Computer
  110.        Software clause at 252.227-7013.
  111.  
  112.        GENERAL
  113.  
  114.        This agreement will be governed by the laws of the State of
  115.        California.
  116.  
  117.        This agreement is the entire agreement between Pearl Software
  118.        and the owner and supercedes any other communications or
  119.        advertising with respect to the program and accompanying docu-
  120.        mentation.
  121.  
  122.        If any provision of this agreement is held invalid, the
  123.        remainder of this agreement shall continue in full force and
  124.        effect.
  125.  
  126.        You are encouraged to fill out and return the Pearl Registra-
  127.        tion Card (either by US or E-mail) included with the program in
  128.        order to be eligible for customer service and support and
  129.        notice of updates and enhancements.
